1. Seller identity
These Terms of Sale govern the contractual relationship between Prosenix, whose registered office is at 190 Avenue Thiers, Bâtiment Étoile Part-Dieu, 69006 Lyon, France (“Prosenix”, “we”, “us”), and any person making a purchase on prosenix.com (“you”, “the customer”).

2. Products and availability
The products offered are those displayed on the site at the time of your visit, subject to available stock. Photographs and descriptions are provided for information only; minor variations in colour or appearance may exist. If a product becomes unavailable after your order is confirmed, we will inform you by email. You may then choose a full refund or a substitute product.

3. Prices and payment
Prices are shown in euros, including all taxes (TTC), excluding delivery costs. Delivery is free within metropolitan France. We may change prices at any time, but changes do not affect orders already confirmed.

Payment is due when you place your order. Accepted payment methods are Visa, MasterCard, and PayPal. Payment is charged when the order is confirmed. Transactions are secured with SSL encryption and, where required by your bank, Strong Customer Authentication under PSD2.

4. Formation of the contract
The contract of sale is formed when we confirm your order by sending a confirmation email. We may refuse an order in the event of a prior dispute, suspected fraud, or a clearly incorrect delivery address.

5. Right of withdrawal
You have 14 days from receipt of the product to exercise your right of withdrawal, under the conditions set out in our Return and Refund Policy, which forms part of these Terms of Sale.

6. Guarantees
You benefit from the legal guarantee of conformity under Articles L217-3 et seq. of the French Consumer Code and the legal guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code. The conditions for exercising these guarantees are set out in our Return and Refund Policy.

7. Liability
We are not liable for indirect losses resulting from the use of our products, or for delays caused by force majeure or by the carrier. To the extent permitted by law, our liability is limited to the amount of the relevant order. Nothing in these Terms of Sale limits any rights you have under mandatory French consumer law.

8. Personal data
The processing of personal data is described in our Privacy Policy, available from the website footer. The Privacy Policy is separate from these Terms of Sale.

9. Mediation and applicable law
These Terms of Sale are governed by French law. If a dispute arises, you may use a consumer mediator free of charge. The list of approved mediators is available on the website of the Commission d’évaluation et de contrôle de la médiation de la consommation. If no amicable resolution is reached, the French courts have jurisdiction, without prejudice to the protective jurisdiction rules applicable to consumers.
